Uncertain future on Trumps new move
President of United States Mr Trump has signed an order extending the previous order of restricting the people to the country until the end of December this year. This order has in the middle of the fight against Coronavirus and many people are stuck in home countries and unable to go back to the US for work. This order reportedly has been taken to help the citizens of the United States in securing the jobs in comparison to foreigners.
On Tuesday 23rd June, Donald Trump has taken a decision to restrict people coming to the US for work. Previously in the middle of the coronavirus, Trump has issued an order that all the WOrking people Outside US will not be able to come back to the US for a period of 60 days. This decision was reportedly taken to protect the domestic people from coronavirus and also to help domestic working people to secure jobs on priority to foreign working people. But now this 60 days period was extended till the End of this year.
What does this mean? Now according to this order, a new visa will not be given to working people who wanted to fly to us for work. hence if your visa is expired and you are stuck in your country example India and want to get your visa stamped, then you cannot get the visa till the end of December.
Popular work visas including the much-coveted H-1B and H-2B, and certain categories of H-4, J, and L visas shall also remain suspended until December 31, the White House said in a press note.
White House believes that the economy of the US has suffered because of the coronavirus pandemic and lockdown and many domestic people have lost their jobs. Now to secure jobs to these domestic workers it is important that these domestic working people need to be protected from the competition of foreign working people.
Now if you want to know the details of these visas. H1B, H2B and others are the visas that are given to foreign highly skilled workers who wanted to work in the US. And every year there is a higher number of visas cap that are issued to people. Embassy cannot issue visas more than this capped number. Of all these visas, H1B is the most popular and particularly among IT companies. Every year the government has a cap of 85,000 total H1B visas. Out of these 65000 are issued to highly skilled workers, and remaining will be given to those highly skilled workers who have a higher education or masters degree from American University.
Now how this decision will affect Indians.
Not to sum it up, just assume different scenarios, If you already have an US visa stamped and you are presently in US, then there is no worry for your. You can stay in US as long as your visa expires. And you can continue to work in US till your visa expiry.
If you have returned to India before corona and your visa has not expired then you can travel back to US when the flight resume. You can travel on your current visa if not expired and continue your work.
But if you have returned to India because your visa is expired and waiting for Visa stamping, then you will not get the visa stamped till end of December this year. This means that you cannot travel back to US for work. You can only travel only after visa stamping is resumed. The present decision to restrict immigration and non-immigration workers will affect these people who don’t have an unexpired visa on June 23rd.
In January 2017, after taking over as the president of the US, Trump had hinted that the low-cost workers were hampering the economy and undercutting jobs of citizens. The US had then hinted at reforming the “broken” H-1B visa system.
Trump seized the opportunity provided by the economic contraction due to Covid-19 by first banning the entry of non-immigrant workers till June 23, and then extending it till December 31.
In his executive order extending the ban, Trump said that while under normal circumstances, “properly administered temporary worker programs can provide benefits to the economy,”, the extraordinary economic contraction created due to Covid-19 posed a threat to the US workers.
Since the Ban is effective immediately, there is no way people can get visa stamped and return back to the US. Hence all processing of H-1B, H-2B, J, and L visa categories will stand suspended till the end of December. This clearly means that if you don’t have a valid visa as of June 23rd, and you are out of India you cannot get a new visa and cannot travel to the US till the end of December.
But there is an exception that is given for few sections of people. These include Essential services workers and health services representatives. But the decision by the consular officer of immigration services is final in such scenarios.
This decision is going to affect the IT companies in a large manner. many people who cam back to India for visa stamping will not be able to travel back to US. Considering the length of the period, many people are in the situation of losing the job.
Many businessmen, leaders have already started to criticize this new move by Trump. Sundar Pichai CEO of Google and Apple CEO have already expressed their views on this decision on this new order.

Now this will have very worse effects on the people who came back to the home country for visa stamping. They are at the mercy of the company no. Whether the company in the US will allow these people to work from home till the end of the December of will lay off them and chose domestic workers. There is also a criticism to call back this order and reduce the timeline. Some people will claim that this move came before the scheduled presidential elections this year. This order will keep trump ahead in the election this year. So considering these weather the white house will reduce and revoke this order or will keep it until the end of December.
